AJC NDA testifies to appeal The Courts non-conforming use

Representatives from the Ardenwald Neighborhood Association and neighborhood residents testified today to appeal the Type II decision on Eastmoreland Racquet and Courts Club.

About 30 people packed into the Hearing Room at the Bureau of Development Services Monday morning to hear testimony in support of the appeal to the decision in case LU 13-231651 NU (non-conforming use).

Ardenwald-Johnson Creek Neighborhood Association land-use chair Lisa Gunion-Rinker immediately requested the record to remain open in her testimony.

A request to leave the record open grants a seven-day extension before the hearing officer can make a decision.

Firends of Tideman Johnson Park representative Marianne Colgrove also testified in support of the appeal.

The Eastmoreland Racquet and Courts Club owner, Terry Emmert, was present at the appeal hearing.

Council approves Limited Commercial zoning amendment

The Milwaukie City Council approved ZA-14-03 Limited Commercial (C-L) zoning amendments 4-0 at the January 20, 2015, regular council meeting. The zoning amendments will allow the businesses along SE 32nd Ave. surrounding at SE Olsen St. to become “eating establishments.” An appeal period is open until 5:00 p.m. PT on February 4, 2015.

Council to hold hearing on 32nd Ave. Limited Commercial Zone amendment

The Milwaukie City Council will hear public comments on ZA-14-03, which allows for eating establishments at businesses at the intersection of SE 32nd Ave. and SE Olsen St. at the regular council session on January 20, 2015, 7:00 p.m. at Milwaukie City Hall.

ZA-14-03 allows for amendments to the C-L Limited Commercial Zone to include “eating establishments” for businesses located in the SE 32nd Ave. and SE Olsen St. intersection area.

The Planning Commission already held a hearing on November 25, 2014.

The public can comment at the City Council regular meeting on Jan. 2oth, or in writing before the regular meeting.

Public comments will be accepted for a Type II proposal in the Ardenwald-Johnson Creek Neighborhood within the Portland city limits.
